Société d'Exploitation de la Tour Eiffel, the organization that manages the tower, notes this on its website. “Daytime views from the Eiffel Tower are rights-free." But it continues to read: "However, its various illuminations are subject to author’s rights as well as brand rights. Usage of these images is subject to prior request from the Société d’Exploitation de la Tour Eiffel."

After questioning SETE about this, their answer was that "if it is not commercial, there are no fees". This image is not commercial, and to my belief I am not breaking any author's rights or brand rights for many different reasons. I am aware that very recently there was a desire of someone to start charging for every photo taken with the Eiffel Tower, however I am not aware if that moved forward or not. In any case, if anyone feels harmed on this or any of other photo, I will be glad to discuss the subject, and even take out the photo.
