Eastern State Penitentiary is classified as being in a state of "semi ruin". It was opened in 1829 and remained in service till 1971. It is being renovating cell block by cell block. Some of the cell blocks you can enter and look around but others are barred off due to the dangerous conditions that exist in that particular block. Personally speaking, I would definitely take the chance to get some photos. I am quite sure most people here would, too.
